1. Terms of Service

1.1 Acceptance of Terms

1.2 Age Requirement

You must be at least 16 years old to use Picarta. By using our services, you confirm that you meet this age requirement. If you are under 16, please do not use our services.

1.3 Account Registration

  • You can use Picarta without an account with limited features
  • Registered users gain access to additional features
  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate information when creating an account
  • Notify us immediately if you suspect unauthorized access to your account

1.4 Service Description

Picarta offers:

  • Free Tier: Limited access to our geolocation services.
  • Premium Features: Enhanced functionality for paid users.

We use artificial intelligence to analyze uploaded images and identify the location where the photo was taken. Results are estimates and may not always be completely accurate.

1.5 Payment and Refund Policy

Pricing:
Premium features require payment. Pricing details are available on our website and during the subscription process.

Refund Policy:
We want you to be satisfied with our service. If you are not satisfied with your purchase, you may request a full refund within 14 days from the date of purchase. To request a refund, contact us at info@picarta.ai with your account details and order information.

Refund requests made after the 14-day period will be evaluated on a case-by-case basis at our sole discretion.

1.6 Acceptable Use

You agree to use Picarta responsibly and legally. You must not:

  • Upload images that violate any laws or regulations
  • Upload images containing illegal content or depicting illegal activities
  • Upload images that infringe on others' intellectual property rights or privacy
  • Use our services to harass, stalk, threaten, or harm others
  • Upload images of children under 16 years old, except in cases of legitimate concern for safety or law enforcement purposes
  • Attempt to reverse engineer, hack, or compromise our systems
  • Use automated tools to scrape or extract data from our services
  • Engage in any activity that disrupts or interferes with our services

You are solely responsible for ensuring you have the necessary rights and permissions to upload images to our service.

1.7 Content and Intellectual Property

Your Content:

  • You retain all ownership rights to the images you upload
  • By uploading images, you grant us a limited license to process them solely to provide our geolocation services

Our Intellectual Property:

  • All content, features, and functionality of Picarta are owned by Picarta and protected by copyright and intellectual property laws
  • You may not copy, modify, distribute, or create derivative works without our written permission

1.8 Service Availability and Modifications

  • We strive to keep Picarta available but cannot guarantee uninterrupted service
  • We may modify, suspend, or discontinue any part of our services at any time
  • We reserve the right to update these terms and will notify you of material changes

1.9 Disclaimers and Limitations

No Warranties:
Picarta is provided "as is" without warranties of any kind. We do not guarantee the accuracy of location predictions.

Limitation of Liability:
We are not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the past 12 months.

Accuracy:
Photo location predictions may be inaccurate. We cannot guarantee absolute precision, and you should not rely solely on our results for critical decisions.

1.10 Indemnification

You agree to indemnify and hold Picarta harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.

1.11 Termination

  • You may stop using Picarta at any time
  • You may delete your account at any time from your account settings page or by contacting us at info@picarta.ai
  • We may suspend or terminate your access if you violate these terms
  • Upon termination, your right to use our services ends immediately

1.12 Governing Law and Dispute Resolution

These terms are governed by the laws of Italy and the European Union. Any disputes will be resolved in the courts of Italy. By using Picarta, you consent to the exclusive jurisdiction of Italian courts.

2. Privacy Policy and Consent to the Processing of Personal Data

Pursuant to Regulation (EU) 2016/679 (GDPR – General Data Protection Regulation) and Legislative Decree 101/2018 implementing it within the Italian Privacy Code (D.lgs. 196/2003)

Introduction

This privacy policy applies to www.picarta.ai, the Picarta platform, Picarta services, and all related or connected services (collectively, the "Services"). It describes the data collected by Picarta and the ways in which such data are used and protected.

For the purposes of this policy, the term "Picarta" refers to Picarta S.r.l.

2.1 Data Collected

Information You Provide

Picarta collects the content and information you provide when using our Services — for example, when you create an account or communicate with us. This may include:

  • your email address, username, and encrypted password;
  • account preferences and settings;
  • messages or inquiries you send to our team.

We also collect information anonymously about how you interact with the Services (e.g., duration of visits, pages viewed, features used), solely to improve service quality and security.

Information Related to Uploaded Images

When you upload an image to our site or platform:

  • we collect only the visual content of the image, which is processed to estimate the approximate geographical location represented in the photo;
  • the image is processed automatically and deleted immediately after analysis;
  • we do not collect or store EXIF data, geotags, or any embedded metadata;
  • we never associate images with identified or identifiable individuals.

Our system is designed to operate completely anonymously: no image or data is linked to any individual user.

Device Information

We collect technical information about the devices you use to access our Services, such as:

  • browser type and version;
  • operating system and screen resolution;
  • anonymized IP address;
  • session time and duration.

These data are collected only in aggregated and anonymized form, exclusively for statistical and functional purposes.

Information from Third-Party Partners

We may receive technical or aggregated information from third-party partners (for instance, hosting providers or analytics tools), solely to ensure service continuity and security.

2.2 Purpose of Data Processing

The processing of personal data is carried out for purposes connected to, instrumental to, and necessary for accessing and using the Picarta platform and Services.

Purposes Not Requiring Consent

These include processing necessary to:

  • provide access to and use of the platform and Services;
  • activate, manage, and maintain your account;
  • ensure the security and integrity of the platform (e.g., preventing misuse or unauthorized access);
  • comply with legal or regulatory obligations;
  • personalize your service experience (e.g., language or interface preferences);
  • provide technical assistance and support.

These purposes are based on contractual necessity or legitimate interest of the controller.

Purposes Requiring Consent

Your explicit consent will be requested only for:

  • sending informational or promotional communications about our Services;
  • using non-essential analytical cookies (e.g., some features of Google Analytics with IP anonymization).

2.3 Third-Party Websites

Third-party websites that can be accessed through our Services are not covered by this policy. Picarta disclaims any responsibility regarding their content or data processing practices. Their data use is governed by their respective privacy policies.

Some technical data (e.g., analytics or hosting) may be processed on servers located in the United States, under the European Commission's Standard Contractual Clauses.

2.4 Data Processor and Controller

Data Processor

Data are processed at Picarta's operational offices or on servers located within the European Union, using electronic tools and in compliance with the security measures required by Articles 32 and following of the GDPR. However, part of our infrastructure is provided by Amazon Web Services (AWS), which may perform data backups or replications on servers located in the United States.

In such cases, Picarta ensures that all transfers comply with Articles 44 and following of the GDPR by implementing Standard Contractual Clauses (SCCs) approved by the European Commission and relying on the EU–US Data Privacy Framework (July 2023) applicable to certified providers such as AWS.

These mechanisms guarantee that your data is handled with a level of protection consistent with European privacy and security standards.

2.6 Mandatory or Optional Nature of Data Provision

Providing the requested data (e.g., email and credentials) is mandatory in order to use the platform. If you choose not to provide these, Picarta will be unable to provide the Services.

Uploading images or other content is entirely anonymous. Picarta does not pre-screen user content but reserves the right to remove images or materials deemed inappropriate, illegal, or contrary to our terms of service.

2.7 Data Retention Periods

  • Uploaded images: deleted immediately after processing.
  • Account data: retained for as long as your account is active or until deletion is requested.
  • Security and log data: retained for up to 12 months unless required longer by law.
  • Marketing data (with consent): retained for up to 24 months.

After these periods, data are permanently deleted or irreversibly anonymized.

2.8 Data Subject Rights

In accordance with Articles 15 – 22 of the GDPR, you have the right to:

  • obtain confirmation of whether we process data concerning you;
  • access your personal data and obtain a copy;
  • request correction or updates;
  • request deletion ("right to be forgotten") or restriction of processing;
  • object to processing for legitimate reasons;
  • obtain data portability in a structured, machine-readable format;
  • withdraw consent at any time, without affecting prior lawful processing.

You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) at www.garanteprivacy.it.

Picarta implements appropriate technical and organizational measures to protect data from unauthorized access, loss, or alteration, including:

  • encryption of data in transit and at rest;
  • secure authentication and controlled access;
  • periodic backups and continuous monitoring;
  • staff training on privacy and security;
  • regular security testing.

However, no system is entirely invulnerable. We encourage users to choose strong passwords and avoid sharing them.
